Terms and Conditions
These terms and conditions (“User Terms”) govern your visit to and usage of the Mobile Application and Site, whether accessed through a computer or a mobile phone, the Service, and the Application. They also apply to all information, recommendations, and services provided to you on or through the Site, the Service, and the Application.
By checking and agreeing to “I agree to the Terms & Conditions and Privacy Policy,” you are indicating your consent to be legally bound by these User Terms. Prior to using the mobile application/site, please read and comprehend these User Terms in their entirety. If you do not agree with any aspect of these User Terms, kindly refrain from using the mobile app/Site or accessing any of the services provided therein.
Your acceptance of these User Terms constitutes a binding agreement between you and ZECT concerning the use of the mobile application/site.
Your acceptance of the User Terms and Conditions also encompasses your acceptance of the privacy policy available at https://www.zect.in/privacy-policy.php
Upon accepting these User Terms and Conditions, you also grant ZECT permission to send you promotional emails and SMS alerts periodically.
DEFINITIONS
The capitalised terms listed below will have the meanings attributed to them in these User Terms:
- “Account” refers to the account established by the Customer within the Mobile Application for utilising the Services provided by ZECT.
- “Application” denotes the mobile application named “ZECT” updated by ZECT periodically.
- “Convenience Fee” signifies the fee paid by the Customer to ZECT for the Service, encompassing technology services, customer support, and cashless payment options. The Convenience Fee applies to every booking made through the Site. This fee excludes any applicable taxes on the Convenience Fee.
- “Cancellation Fee” designates the Convenience Fee incurred for cancelling a booked Electric Vehicle Charging Session time slot. The Cancellation Fee excludes any applicable taxes on the Cancellation Fee.
- “Customer/You/EV Driver/User” refers to an individual who maintains an Account on the Application.
- “E-Wallet” represents a pre-paid instrument utilised for making payments.
- “EV (Electric Vehicle) Charging Session” covers the duration commencing when a user initiates and concludes the charging of an electric vehicle.
- “Fare” signifies the amount in Indian Rupees displayed on the Application, representing the fare due for energy consumption during an EV Charging Session. The Fare excludes any applicable taxes on the Fare.
- “Registration Data” pertains to and may incorporate the accurate and up-to-date name, email ID, phone number, and other necessary information as requested by ZECT from the Customer periodically for registration within the Application.
- “Service(s)” denotes the facilitation of EV Charging service by ZECT via the Application, telephone request, or Site booking.
- “Site” refers to the Application and the website https://www.zect.in/managed by ZECT, or any other software enabling Application use.
- “Total Payable Amount” encompasses the Fare, Convenience Fee, Cancellation Fee, and any applicable taxes, as may be relevant periodically.
- “T&Cs” and “User Terms” denote these Customer terms and conditions.
- “Charge Spot” designates an instrument/machine utilised for charging an electric vehicle.
- “Charging Station” refers to a location equipped with one or more Charge Spots.
ELIGIBILITY
You will be considered “Eligible” for utilising the Services only if you meet the following criteria:
- You have attained a minimum of 18 (eighteen) years of age.
- You possess the legal capacity to enter into a contract in accordance with the Applicable Laws.
- If your jurisdiction restricts service use due to age or contract-related factors, you must abide by these constraints.
REGISTRATION AND ACCOUNT
You acknowledge that you can Register/Sign Up within the Application after fulfilling the prerequisites by providing your Registration Data.
It is your responsibility to ensure that the Registration Data you provide is accurate, current, complete, valid, and true, and to update it as needed. We bear no liability for incomplete, false, outdated, or incorrect Registration Data provided by you.
You are solely accountable for maintaining the confidentiality of your Registration Data and are liable for all activities and transactions conducted via your Account, whether initiated by you or any third party. Your Account cannot be transferred, assigned, or sold to a third party. We are not liable for any losses resulting from unauthorised use of your password or Account, whether with or without your awareness.
We retain the right to suspend or terminate your Account immediately and for an indefinite period if we suspect that your Registration Data or any other data you provide is incorrect or false, your Account's security is compromised, or for other reasonable and equitable grounds.
Except for Registration Data and other data submitted by you during the use of any other service offered through the Application (“Permitted Information”), ZECT does not encourage or require you to transmit any confidential or proprietary information via the Application or otherwise, except where mandated by Applicable Laws. By agreeing to these User Terms, you consent that any information or materials provided to ZECT beyond Permitted Information will not be deemed confidential or proprietary.
You are responsible for ensuring that you download the appropriate application for your device. We are not liable for any incompatibility or incorrect version of the Application downloaded to your device. We retain the right to terminate the Service and Application use if you employ an incompatible or unauthorised device.
You are authorised to establish only one Account linked to your Registration Data. In case of unauthorised Account use, promptly notify us at care@zect.in
SERVICES
By utilising the Application or the Service, you acknowledge and agree to the following:
- You will solely use the Service or download the Application for personal use and will not distribute or transfer it to a third party.
- You will not utilise an account belonging to a person other than yourself without appropriate authorization.
- You will not exploit the Service or Site/Application for unlawful activities.
- You will not engage in any activities that could harm the Service, Site, Application, or our network.
- You will provide ZECT with any information and documents requested reasonably.
- You will exclusively use an authorised network for Service use.
- You understand that requesting Services, whether through messages, the Site, or calling ZECT's toll-free number, incurs standard messaging, data, and voice charges from both your phone network and our service providers.
- You will adhere to the Applicable Law in your domicile and residence country, as well as the country, state, and/or city where you access the Site, Application, or Service.
- You are aware of and agree to comply with the Information Technology Act, 2000, and related regulations.
ZECT reserves the right to promptly terminate the Service and Application use due to non-compliance with the above requirements. We will retain the information provided by you or record your calls to facilitate communication on Service matters. You must inform ZECT of any changes in your provided information.
ZECT or its authorised representative may convey information about services, offers, discounts, and promotions via SMS or email to your registered mobile number/email ID. You can choose to stop receiving such information at any time by using the link provided in the Application.
By using the Application, you grant ZECT a non-exclusive, global, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise copyright, publicity, database rights, or any other rights you possess in your information, in any known or future media, concerning your information. You also allow ZECT to share your information and/or permitted information with third parties.
You agree and permit ZECT to share any information you provide with third parties to facilitate the provision of value-added services offered by those parties to you and/or to provide value-added services to you by ZECT. You expressly consent to receiving communications from ZECT/third parties offering value-added services through your registered phone number, email ID, or the Application. You agree not to hold ZECT responsible for such communications from third parties, and acknowledge that such communication is not spam or unsolicited, nor a violation of your registration on the national do-not-call registry.
In the event you cannot access your Account, inform us at care@zect.in and submit a written request to block your Account. We are not liable for unauthorised transactions conducted through your Account.
CONFIRMATION OF BOOKING
ZECT will confirm or decline your EV booking request based on available charging time slots at Charge Spot/Station, communicated to you via SMS or email. If the booking is confirmed, review the booking details, including booking time and location. Any incorrect details must be reported immediately by calling our Toll-Free Number (1-800-xxx-xxxx).
You are responsible for any consequences or delays resulting from your failure to review the confirmation SMS/email or promptly report incorrect details to ZECT.
PAYMENT
At the conclusion of an EV Charging Session, the Total Payable Amount for EV Charging will be collected by ZECT, with any excess payment refunded to the EV User’s Wallet.
ZECT will provide a receipt for the Total Payable Amount at the end of the EV Charging Session.
All applicable taxes for the Service Charge, Cancellation/Reschedule Fee are payable by you to ZECT, as relevant.
You can pay for the Service Fee through any of the following methods:
- E-Wallet Payment: ZECT offers online payment through a third-party E-Wallet. E-Wallet payments are inapplicable for phone bookings or when users are not logged into their Accounts on the Site. E-Wallet payments are subject to the terms and conditions of the Payment Processor engaged by ZECT.
- Credit Card/Debit Card/Net Banking Payment: The EV Charging Service Fee can be paid using the services of an authorised payment gateway/processor (“PG”) as authorised by ZECT. Your authorization permits the PG to debit or credit the bank account associated with your payment details. This authorization extends to processing transactions initiated by you at any of ZECT's affiliates. The authorization remains effective as long as you maintain an Account. If you delete your Card Details or Account, the PG won't process further transactions initiated by you. Your authorization is subject to PG terms.
- ZECT Wallet Payment: Payments through Net Banking/Credit Card/Debit Card will be credited to your ZECT Wallet for subsequent payment processing.
Issues with payment, excluding Site-related errors, should be resolved directly between you and the Payment Processor. ZECT is not responsible for unauthorised E-Wallet use during or after service use.
CANCELLATION, RESCHEDULE & REFUND POLICY
Applicable to Public/Commercial Charge Spots/Stations
You acknowledge and accept the ability to cancel/reschedule an EV booking at any time, subject to a Cancellation/Reschedule Fee as detailed below:
The applicable Cancellation/Convenience Fee will be communicated in advance whenever you attempt to cancel/reschedule a booking. This notification will appear on the Application and/or the Site. Cancellation rates are subject to modification.
Cancellation/Convenience Fees are levied under the following circumstances:
- If you cancel your booking post-booking.
- If the EV Driver is delayed for over fifteen (15) minutes from the booking time slot, leading to automatic cancellation and a Cancellation Fee.
Rescheduling is fee-free, but a Charging Rate Change may apply according to the new rate schedule. If Charge Spot/Station maintenance or out-of-service situations necessitate booking cancellation by ZECT Admin or Charge Spot/Station Owner, no Cancellation Fee will apply, and a full refund will be issued.
CANCELLING A BOOKING
For online booking cancellation:
Login to ZECT app -> Main Menu -> My Bookings -> Click “X” to Cancel the selected booking and proceed. You will receive SMS confirmation.
RESCHEDULING A BOOKING
For booking rescheduling:
Login to ZECT app -> Main Menu -> My Bookings -> Reschedule the selected booking by choosing an available time slot. You will receive SMS confirmation.
CANCELLATION PROCESSING TIME
Cancellation requests require between 24 to 48 hours approximately to process the refund. You will be notified of the refund status via email/SMS.
REFUND MODES AFTER CANCELLATION
For payments made through our payment gateway, the refund will be credited to your ZECT Wallet within 24 hours after successful processing.
